Cory Kirchert
PartnerCory’s experience and training span the related areas of securities law and regulation, finance and investment, real estate, and financial accounting. He is very familiar with federal and state financial laws, initiating and submitting whistleblowing submissions, conducting government investigations and negotiations, and litigating on behalf of defendants and plaintiffs. He also has extensive experience in perfecting appeals and submissions for certiorari at federal and state levels. He has been on both sides of actions involving CEOs, CFOs, COOs, other C-suite officers, and other managers and employees.
As a former investigative attorney with the Securities and Exchange Commission and trained accountant (CPA, inactive) Cory Kirchert develops and employs detailed analyses of relevant commercial and financial transactions to identify and exploit strengths and weaknesses of theories of liability for the benefit of his clients. Cory spent over twenty years investigating and causing actions to be brought and resolved against domestic and foreign issuers, executives, auditors, and market participants, such as broker-dealers and underwriters. Since leaving the government, Cory has represented among others, CEOs, CFOs, RIAs, REITs, and other pooled investment vehicles, and by identifying, developing, and persuasively presenting his clients’ positions, factually and legally he has generated highly favorable resolutions.
In representing clients who are the possible subject of governmental interest, Cory’s objective is to bring such matters to a close as quickly and as possible. “Truncating” investigative and litigated matters prevents them from building “momentum” and leading to unfair and unwarranted results.
Cory believes that optimal legal representation in government investigations and litigation requires not only strong skills in identifying and arguing the applicable law, state of the law, and significant facts but also rests on an attorney’s abilities to identify the counter-party’s assumptions, to develop evidence from data and information that might never otherwise be considered, and to explore and present, when needed, novel approaches to legal questions.
Cory has been an adjunct professor of in legal writing, financial accounting, and business, and has a master’s degree in business administration, and two other master's degrees, one in philosophy and another in law. His teaching experience has enhanced his written and oral advocacy skills for his clients.
Cory assists in forming, incorporating, and obtaining tax-exempt status under Section 501(c)(3) of the federal tax code for nonprofit corporations created to promote animal protection tying his corporate and financial training and experience with a love of animals.
